These Terms & Conditions (“Terms”) govern your access to and use of keepitlux.com and your purchase or use of products and services offered by Keep It Lux (“Keep It Lux,” “we,” “us,” or “our”).

These Terms apply to all visitors, customers, purchasers, and users of our website and services, including customers purchasing merchandise, submitting luxury sourcing requests, reserving merchandise, or participating in an approved Lux Reserve payment arrangement.

By accessing our website, submitting an order or request, making a payment or deposit, or otherwise using our services, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. ABOUT KEEP IT LUX

Keep It Lux is a luxury re-commerce and sourcing business specializing in authenticated pre-owned and other luxury merchandise.

Our merchandise may include:

  • Designer handbags
  • Fine jewelry
  • Luxury watches
  • Designer accessories
  • Shoes and fashion
  • Small leather goods
  • Collectibles
  • Other luxury merchandise

Our inventory may be acquired through luxury resellers, dealers, private sellers, estate sources, wholesalers, secondary-market businesses, and other reputable sources.

Unless expressly identified otherwise, Keep It Lux is an independent reseller and is not affiliated with, sponsored by, authorized by, or endorsed by the designers or luxury brands whose merchandise may appear on our website.

All trademarks and brand names remain the property of their respective owners.

2. PRE-OWNED & UNIQUE MERCHANDISE

Many products sold by Keep It Lux are pre-owned, vintage, discontinued, limited-production, or otherwise unique secondary-market merchandise.

Customers acknowledge that pre-owned merchandise may show signs of previous ownership or use.

These may include minor:

  • Scratches
  • Scuffs
  • Creasing
  • Patina
  • Tarnishing
  • Hardware wear
  • Interior wear
  • Leather variation
  • Fabric wear
  • Odor associated with age or storage
  • Other characteristics consistent with the item's age and prior use

We make reasonable efforts to photograph and describe material characteristics and known condition issues accurately.

Because many items are one-of-one, an identical replacement may not be available.

Normal characteristics of pre-owned merchandise should not automatically be considered defects.

3. PRODUCT PHOTOGRAPHS & DESCRIPTIONS

Keep It Lux makes reasonable efforts to provide accurate photographs, descriptions, dimensions, colors, condition information, and other product details.

However, colors and appearance may vary depending on lighting, photography, screens, monitors, devices, and display settings.

Measurements may be approximate.

We reserve the right to correct typographical errors, pricing errors, product descriptions, photographs, availability information, or other inadvertent errors.

If a material error affects an order before fulfillment, we may contact the customer to provide appropriate options, including cancellation and refund where required.

4. AUTHENTICITY

Authenticity is fundamental to Keep It Lux.

We source merchandise with the intention of offering authentic luxury products and may use internal review, documentation, provenance information, recognized third-party authentication services, or a combination of these methods.

Authentication methods may vary by product, brand, value, source, and circumstances.

Unless specifically stated on the applicable product page, authentication by a particular third-party service is not guaranteed.

If a customer has a reasonable authenticity concern regarding an item purchased directly from Keep It Lux, the customer should contact us promptly so the matter can be reviewed.

Nothing in these Terms limits any rights a customer may have if merchandise is materially misrepresented or determined not to be authentic.

5. INDEPENDENT RESELLER

Keep It Lux operates independently from the luxury brands represented by products offered through our Services.

Unless expressly stated otherwise, Keep It Lux is not an authorized dealer, distributor, franchisee, representative, or agent of those brands.

References to designer names, trademarks, logos, model names, and product names are used for identification and descriptive purposes.

6. PRICING

Prices displayed by Keep It Lux reflect our determination of the selling price for the particular item and may consider factors including:

  • Brand
  • Model
  • Condition
  • Rarity
  • Availability
  • Acquisition cost
  • Authentication
  • Market demand
  • Comparable secondary-market pricing
  • Included accessories
  • Current market conditions

Secondary-market values fluctuate.

Keep It Lux does not guarantee that an item's future resale value, appraisal value, retail value, or value offered by another dealer or marketplace will equal the price paid through Keep It Lux.

Prices may change at any time before an order is completed.

Once an order is accepted, the applicable purchase price is the price confirmed for that transaction, subject to correction of genuine pricing or listing errors as permitted by applicable law.

4. HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information to third parties that help us operate Keep It Lux, including:

If we cancel a paid order before fulfillment, amounts owed back to the customer will be refunded as required by applicable law and our applicable policies.

Because Keep It Lux sells high-value merchandise, certain transactions may require additional verification.

We may temporarily delay fulfillment while legitimate fraud-prevention or payment-verification procedures are completed.

Keep It Lux reserves the right to decline transactions presenting significant fraud, payment, security, or identity concerns.

9. PAYMENT

Payment must be made using payment methods accepted by Keep It Lux at the time of purchase.

Depending on the transaction, available methods may include credit or debit card, electronic payment, bank transfer, or other approved methods.

Payment processing may be provided by Shopify or other third-party payment providers.

Customers represent that they are authorized to use the payment method submitted.

Additional requirements may apply to high-value transactions.

10. LUX RESERVE — PAY OVER TIME

Keep It Lux may offer qualifying customers the opportunity to reserve selected merchandise and pay for it over an agreed period through Lux Reserve.

Lux Reserve is a reservation/payment arrangement and is governed by the specific Lux Reserve terms presented to and accepted by the customer.

Depending on the transaction, the total Lux Reserve price may differ from the item's standard immediate-purchase price.

Before entering a Lux Reserve arrangement, customers will be informed of the applicable purchase price, payment schedule, amounts due, and other material terms.

Unless expressly stated otherwise, merchandise placed into Lux Reserve remains in the possession of Keep It Lux until the agreed purchase price and all amounts due under the arrangement have been paid.

Participation in Lux Reserve does not itself transfer ownership or possession of merchandise to the customer.

Separate Lux Reserve Terms & Conditions may apply and, where applicable, are incorporated into these Terms.

11. LUXURY SOURCING

Keep It Lux may assist customers in locating specific luxury merchandise through our Luxury Sourcing service.

Customers may submit preferences including:

  • Designer
  • Product
  • Style
  • Color
  • Size
  • Condition
  • Budget
  • Desired timeframe

Submission of a sourcing request does not guarantee that Keep It Lux will locate the requested merchandise.

Availability and pricing of secondary-market luxury goods can change rapidly.

Any estimated price provided before an item is located is informational unless expressly identified as a binding offer.

When we locate a suitable item, the customer will receive applicable pricing and purchase information.

Sourcing fees, deposits, commitments, cancellation provisions, or other transaction-specific requirements will be disclosed before the customer becomes obligated to them.

Separate Luxury Sourcing Terms may apply and, where applicable, are incorporated into these Terms.

12. ONE-OF-ONE INVENTORY & AVAILABILITY

Many Keep It Lux products are unique and available in quantities of one.

Placing an item in a shopping cart does not necessarily reserve it.

Unless otherwise stated, merchandise is not secured until the applicable checkout, payment, deposit, or reservation process has been successfully completed and accepted.

Occasionally an item may become unavailable due to simultaneous purchases, inventory synchronization, sourcing issues, damage discovered before shipment, authentication concerns, or other circumstances.

If we are unable to fulfill a completed purchase, we will provide the customer with the remedies required by applicable law.

13. SHIPPING & DELIVERY

Shipping options, rates, estimated delivery times, signature requirements, insurance options, and restrictions may vary depending on the merchandise and destination.

High-value merchandise may require:

  • Adult signature
  • Direct signature
  • Identification
  • Insured delivery
  • Restricted delivery
  • Other security procedures

Customers are responsible for providing a complete and accurate shipping address.

We may decline requests to redirect high-value shipments after an order has been placed where doing so creates security or fraud concerns.

Shipping and delivery estimates are estimates unless expressly guaranteed.

If we cannot ship within a promised timeframe, we will handle the delay, cancellation opportunity, and any required refund in accordance with applicable law.

Our separate Shipping & Delivery Policy is incorporated into these Terms.

22. CUSTOMER ACCOUNTS

Customers who create accounts are responsible for maintaining the confidentiality of their login credentials.

You are responsible for activity conducted through your account to the extent permitted by applicable law.

Notify Keep It Lux promptly if you believe your account has been accessed without authorization.

23. INTELLECTUAL PROPERTY

Unless otherwise indicated, content created or owned by Keep It Lux—including website design, original photographs, graphics, written content, branding, logos, marketing materials, and other original materials—is owned by or licensed to Keep It Lux and protected by applicable intellectual-property laws.

You may not reproduce, distribute, modify, publish, commercially exploit, or create derivative works from Keep It Lux proprietary content without permission, except as permitted by law.

Third-party trademarks appearing on our website remain the property of their respective owners.

28. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Keep It Lux and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of our website, Services, or merchandise where such damages may lawfully be excluded.

Where liability may lawfully be limited, Keep It Lux's aggregate liability arising from a particular transaction will not exceed the amount paid to Keep It Lux for the product or service giving rise to the claim.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited or excluded.

29. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Keep It Lux and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Services, violation of these Terms, fraud, or infringement of another person's rights.

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable federal law or non-waivable consumer law provides otherwise.

Before commencing formal legal proceedings, you and Keep It Lux agree to make a reasonable good-faith effort to resolve disputes directly.

Nothing in this provision prevents either party from pursuing rights or remedies that cannot legally be waived.

Any additional arbitration, venue, jury-waiver, or class-action provisions, if adopted by Keep It Lux, will be separately and conspicuously disclosed as required by applicable law.

32. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes in our Services, business model, policies, technology, or applicable law.

Updated Terms will be posted on our website with a revised “Last Updated” date.

Changes will apply prospectively unless otherwise permitted by law.

33. SEVERABILITY
